1. Right to
Use Copyright and Trademark
I. Right to Use Statement: Empowerment
Sanctuary™ reserves all copyright and trademark rights and grants no Right to Use
for any of its products, services or website content to any individual or
entity to be used in any manner whatsoever which is contrary to any part of
Empowerment Sanctuary’s Copyright and Trademark Usage Policy and/or copyright
and trademark law. Website content is defined in Section 2, Subsection II.
II. Retention of Copyright and Trademark:
Purchase or gift receipt of a copyrighted or trademarked product shall not,
under any circumstances, include the purchase or gift receipt of the product’s
copyright and/or trademark.
2. Public Notice
I. Statement of Copyright and Trademark:
Except where otherwise noted and/or held by copyright or trademark, all
products, all services, all notices and policies, all content of the
Empowerment Sanctuary™ website, including all content of the Empowerment
Sanctuary Marketplace™, the Empowerment Boutique™, the Inner Sanctum™, and all website pages
and content therein are the sole property of Empowerment Sanctuary™ and are
protected by copyright and in some cases trademark, with all rights reserved.
II. Website Content Definition: Content
shall include, but shall not be limited to, company name, taglines, logos, site name(s), subsidiary company names, product names, service names, marketing materials, products, services, tutorials,
meditations, educational materials, educational content, all written works, all
graphical works (see the Graphics Usage Policy), all works of art, all images, all audio
files, all video files, all recordings, all internet radio live broadcasts and
archived recordings, all feeds, all articles, all written policies and other written content, all advertisements, and all
advertising content. Content definition shall apply to all content, whether
downloadable, embedded, static or dynamic.
III. Downloadable Product Definition:
Empowerment Sanctuary reserves and retains all copyright and trademark rights to
downloadable recorded and written works created, written, produced, or
otherwise owned by Empowerment Sanctuary. Downloadable recorded products
include, but are not limited to, meditations, guided meditations, certain meditation
musical works, educational materials, educational products, and recorded and written
works of any kind, digital or otherwise.
IV. Public Notice Definition: The
publishing of this notice and/or the trademark and copyright marks (Copyright
©2008 Empowerment Sanctuary™, Empowerment Sanctuary™, The Inner Sanctum™, Empowerment Boutique™, Bountiful Blessing Gift Dollars™, Sanctuary Creations™, Dare to Fly™, Embrace Your Spirit™, and ™et al.), visible throughout
the site, shall hereby serve as notice to the public as to the copyright and
trademark status of the marked graphic, product, product title, product
content, service, service title, company and subsidiary names, taglines, marketing materials of any kind, website, and website content, et al. The absence of marks ( © and/or ™ ) on any of the above protected titles, taglines, graphics, products, or protected works et. al shall not indicate, nor be construed as, being unprotected or otherwise freely available for the taking or infringing.
V. Consequences
of Infringement: Willful
copyright infringement is punishable, at the time of this writing, by a
$100,000.00 fine, plus damages, fees, court costs, lost profits, and other fees
to law. Trademark infringement is punishable, at the time of this writing,
by up to a $250,000.00 fine, plus damages, fees, court costs, lost profits, and
other fees to law.
VI. Notice of Intent: Having notified the
public of the copyright and trademark status of Empowerment Sanctuary's
products, services, company and subsidiary names, taglines, marketing materials, images and graphics, logos, written policies, and all website content in it's entirety, Empowerment Sanctuary and
its representatives reserve the right and hereby make known the intent to
tenaciously pursue a willful copyright infringement suit and/or a trademark infringement
suit, as applicable, against any individual or entity that violates Empowerment
Sanctuary's Copyright and Trademark Usage Policy and/or copyright or trademark
law with respect to Empowerment Sanctuary's protected works.
3. Collaborative Copyright and Trademark Notice
I. Statement of
Copyright and Trademark:
Products and services offered through Empowerment Sanctuary and/or its
website, for which Empowerment Sanctuary holds a share of ownership,
copyright, or trademark due to a collaborative process, are wholly owned,
collectively, by the contributing authors, creators, musicians, and producers. Each
collaborative party shall retain and reserve all copyright and trademark rights
to their contributed share of the collaborative work. Each collaborative party
shall retain the right to pursue an infringement suit, either individually or
collectively with other collaborative parties, against any individual or entity
which violates Empowerment Sanctuary’s Copyright and Trademark Usage Policy
and/or copyright and trademark law with respect to Empowerment Sanctuary's
protected works and/or the works of collaborative parties.
4. Use of Downloadable
Recorded or Written Products
I. Personal Use
Only: Downloadable recorded
or written products, as defined in Section 2, Subsection III, are for personal
use only. At no time does Empowerment Sanctuary infer, nor shall it be
construed on the part of the site visitor, purchaser, downloader, or gift
recipient that the purchase or gift receipt of a product includes the right to
the copyright, trademark, or product license; therefore, site visitor,
purchaser or downloader is not at liberty to resell, re-market, reuse,
repackage, re-record, re-create, copy, alter for the purposes of disguising infringement or for any other purpose whatsoever, or in any way claim ownership or make
creative claim of the downloadable product. Further, site visitor, purchaser,
downloader, or gift recipient may not, for any purpose whatsoever, modify the
content of the downloadable product in any manner whatsoever. Site visitor,
purchaser, downloader, or gift recipient may neither give away their original
product, nor a copy of the original product, to any individual or entity for
any reason.
II. Downloadable
Recorded or Written Products as Gifts: If the downloadable product is being purchased as a gift, the product
will be delivered to the gift recipient directly through the purchase process.
The gift recipient shall be bound to the same statements and conditions of
Empowerment Sanctuary’s Copyright and Trademark Usage Policy in its entirety
and/or copyright and trademark law.
5. Use of Downloadable

6. Downloadable Recorded or
Written Educational Products for Professionals
I. Limitations
on License to Use: At no
time does Empowerment Sanctuary warrant or infer, nor shall it be construed on
the part of the participant or purchaser that the receipt of
a Limited License to Use an educational product includes the
ownership right to the copyright, trademark, or product license; therefore, participant or purchaser is not at liberty to sell or resell, market or re-market, use or reuse,
package or repackage, re-record, re-create, or copy the product except as allowed by an individual in possession of a Limited License to Use contract issued directly to them by Empowerment Sanctuary, or in any way claim ownership or make creative claim of the
educational product. Further, the participant or purchaser may not, for any purpose whatsoever,
modify the content of the downloadable product in any manner whatsoever. Participant or purchaser may neither give away their original product, nor a copy of the
original product, to any individual or entity for any reason.
II. Receipt of
Limited License to Use: Those who
purchase or receive as a gift, a Professional Development Course module shall, upon satisfactory completion of the Professional Development Course module, receive a Limited License to Use for the
purpose of teaching a class, course, or workshop for which they've been certified by Empowerment Sanctuary to teach and using the corresponding materials provided by Empowerment Sanctuary. Specific Uses and Limitations are set forth in the Limited License to Use contract provided to those who successfully complete the Empowerment Sanctuary Professional Development Course module.
7. Addendums
Please Note: Empowerment Sanctuary retains the right to change or modify policies at any time and without notice. However, Empowerment Sanctuary makes every effort to notify members of policy changes via administrative emails.
